The child support receiver is a privileged litigant that despite multiple procedural rules in their favor, they are unable to get the payment of the debt in many cases. This analysis shows that according to the current Chilean law, the family court judge can order the payment of child support with the debtor`s pension funds. To use this way of payment, it is required, from a general point of view, to apply the analogy and rule out a penalty for the debtor and, in particular, to make a series of relevant distinctions in terms of pension funds regulation as well as familiar in order to set out the limits for this way of payment during the child support trial.
