El delito de conspiración debe distinguirse claramente de la categoría &#8216;cómplice&#8217;. Este delito incipiente cumple una serie de funciones diversas que son satisfechas por otros dispositivos jurídicos en los sistemas legales continentales. La membresía a una conspiración genera un estándar para mantener a cada conspirador cómplice en los delitos cometidos por los otros conspiradores. La única restricción a esta prueba de complicidad es que el delito se cometa en cumplimiento del objetivo criminal de la conspiración. Dicha responsabilidad se ve amplificada más aún a partir de la doctrina Pinkerton. La superposición entre estos enfoques crea una red muy complicada de desentrañar. Por ello, en la presente investigación analizaremos la conspiración y su relación otros sistemas de responsabilidad (cómplice, responsabilidad Pinkerton) conforme al arsenal conceptual aportado por el common law, el objetivo principal será su análisis y crítica desde el propio sistema penal norteamericano.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract The conspiracy is a preparatory crime that allows the punishment of people who agree to commit a crime, even if they never carry out their plan or if they are apprehended before reaching their goal. The crime of conspiracy must be clearly distinguished from the category &#8216;accomplice&#8217;. This inchoate crime fulfils a series of diverse functions that are satisfied by other legal devices in continental legal systems. The membership in a conspiracy creates a standard for keeping each conspirator accomplice in the crimes committed by the other conspirators. The only restriction on this accomplice test is that the crime be committed in furtherance of the criminal aim of the conspiracy. This responsibility is further amplified by the Pinkerton liability. The overlap between these approaches creates a very difficult web to unravel. Therefore, in this research, we will analyse the conspiracy and its relationship with other systems of responsibility (accomplice, Pinkerton liability) according to the conceptual arsenal provided by the common law, the main objective will be its analysis and criticism of the North American criminal system itself.]]></p></abstract>
<abstract abstract-type="short" xml:lang="pt"><p><![CDATA[Resumo A conspiração é um crime incipiente que permite punir as pessoas que concordam em cometer um crime, mesmo que nunca levem a cabo o seu plano ou sejam apreendidas antes de atingir o seu objetivo. O crime de conspiração deve ser claramente distinguido da categoria 'cumplice'. Este crime incipiente cumpre uma série de funções diversas que são satisfeitas por outros dispositivos legais dos sistemas jurídicos continentais. A participação em uma conspiração cria um padrão para manter cada conspirador cúmplice dos crimes cometidos pelos outros conspiradores. A única restrição a esse teste de cumplicidade é que o crime seja cometido em cumprimento ao objetivo criminoso da conspiração. Essa responsabilidade é ampliada ainda mais pela doutrina Pinkerton. A sobreposição entre essas abordagens cria uma teia muito difícil de desvendar. Portanto, nesta pesquisa iremos analisar a conspiração e sua relação com outros sistemas de responsabilidade (cumplicidade, responsabilidade Pinkerton) de acordo com o arsenal conceitual fornecido pela common law, o objetivo principal será sua análise e crítica do próprio sistema penal norte-americano.]]></p></abstract>
