Resumen

RODRIGUEZ, L.. The use of Cultural-Anthropologic expertise as judicial proof in Latin America: Reflections from an international workshop. Rev. urug. Antropología y Etnografía [online]. 2017, vol.2, n.1, pp.103-112. ISSN 2393-7068.

Cultural anthropological expert testimony is a form of judicial evidence in legal conflicts. It is an important resource available in many Latin American countries to guarantee a better access to justice of minority populations. This article summarizes information discussed in an international workshop of cultural anthropologists who serve as expert witnesses or research the topic. First, I summarize the legal frameworks that enable the use of this cultural expert testimony in each country. Then, I describe the range of cases and populations for whom cultural expertise has been requested. Third, I compare the production, circulation and use of this testimony. Lastly, I consider some common tendencies in cultural expert testimony in the region, and I make some recommendations as to how this legal tool can be maximized.

Palabras clave : cultural expert testimony; legal plurality; legal anthropology; access to justice; cultural diversity.
