The purpose of this article is to analyze how the Unconstitutional State of Affairs (USA) operates as a mechanism for protecting the fundamental right to education within public educational policy in the law of Peru and Colombia. The study adopts a qualitative methodology with a grounded theory design, using the documentary analysis technique and the documentary analysis guide instrument. The findings indicate that the Unconstitutional State of Affairs is a key tool for the structural protection of rights, particularly in contexts of massive and persistent violations. Its application enables the correction of structural deficiencies and reinforces the State’s responsibility in safeguarding fundamental rights such as education. Moreover, effective state intervention must ensure adequate conditions for all, prioritize vulnerable groups, and promote policies aimed at eliminating structural barriers to achieve inclusive and high-quality education
