Resumen

MAGOJA, Eduardo Esteban. Judicial Interpretation, Environment and Dignity. Rev. Derecho [online]. 2020, n.21, pp.52-71.  Epub 01-Jun-2020. ISSN 1510-3714.  https://doi.org/10.22235/rd.vi21.1860.

In the development of the so-called “Environmental Rule of Law”, there is a very interesting feature which takes place directly based on the commitments assumed by judges: the value of human dignity in relation to the care of the environment. In relation to this, the propose of this paper is to demonstrate how in the recent case-law of the Supreme Court of Argentina, which is related to the human right to water and the protection of the hydrological resources, dignity is at the center of interpretive work and it also constitutes a guiding criterion in judicial decision-making.

Palabras clave : dignity; judicial interpretation; environment; jurisprudence; water resources..
