This article addresses the problem of the existing relation between the point of view of the legal theory and the normativity of law (the latter understood as its moral justification). In order to do so, we will refer to the point of view assumed by the scholars for the explanation of the object of their theories, that is: the law. But we will also analyze which would be that point of view that scholars should take. This article aims to highlight the ambiguity in which all scholars have incurred presenting the key concepts of their theories in order to discuss over this topic.
