This article seeks to renew the understanding of civil mens rea through hermeneutics. In particular, it poses the need and usefulness of the application of the circumstantial evidence, as well as its evidentiary standard, to the civil mens rea. In short, this work does not intend to make an objective turn in the understanding of mens rea. Instead, it proposes a model that facilitates the proof of this element without modifying its subjective character.
