Abstract

The objective of this article is to analyze the causes and precedents that have contributed to the fact that, in Argentina, the designation of the Ombudsman for Children has been judicialized. In the ruling entitled "South Argentina Foundation and others c / Honorable Chamber of Senators of the Nation and other s / Amparo Law 16.986", published on March 9, 2017, the National Court of First Instance in the Federal Administrative Contentious Number 3, exhorted the Congress of the Nation, due to its delay, to appoint an Ombudsman to comply with the provisions of law 26.061.
