The theory of the essential content in the determination of social rights has found some "imperfections", being a category that serves to solve some problems (helps to establish nuclear contents). But it looks insufficient in front of others (eg before each legislative and/or governmental omission -in his case). Underlining the differences -but also the relations- a dialogue between the "essential content" with other categories like the "essential content of human rights" is imposed. The "right to the vital minimum" and the "constitutional minimum (express) content". Without questioning the legitimat- ing capacity of the legislator; nor to ignore the problems derived from its omission in the (lack) of materialization of this type of rights of a benefit character; trusting more in the constitutional justice to contribute -without competing- in realizing these rights from constitutional (express) contents.
