Abstract

DIAZ CHARQUERO, Patricia. Copyright and access to knowledge in Latin America. Database on exceptions to copyright and scenarios that show the regulatory backwardness. Infor [online]. 2022, vol.27, n.1, pp.55-76.  Epub June 01, 2022. ISSN 2301-1378.  https://doi.org/10.35643/info.27.1.11.

This article presents the "Report on the state of copyright flexibilities in Latin American countries", the database of exceptions and limitations created from this report and a case of use of this database. The use case focuses on the analysis of scenarios that constitute common practices for the use of works without express authorization and that are usually excepted in the countries of the global North for reasons of public interest. From the mapping of the normative situation of the Latin American countries, emerges evidence of the existence of different levels of legislative backwardness in the region and of a context of legal uncertainty faced by cultural, research and educational institutions.

Keywords : EXCEPTIONS; COPYRIGHT; REGULATORY BACKWARDNESS; LATIN AMERICA.
