Abstract

PEZZANO, Luciano. AGGRESSION IN THE PRACTICE OF THE SECURITY COUNCIL. Rev. Fac. Der. [online]. 2024, n.58, e204.  Epub Dec 01, 2024. ISSN 0797-8316.  https://doi.org/4.

The article proposes an exhaustive analysis of the practice of the Security Council (SC) regarding aggression in order to assess whether, in any of the more than thirty resolutions that include the term, elements can be found that amount to an act of determination within the meaning of Article 39 of the Charter of the United Nations. It proposes also to specify the meaning and scope given by the SC to the term “aggression” in those resolutions. Although we can conclude that none of them constitutes a Chapter VII determination, the study sheds light on the meaning of aggression in SC practice.

Keywords : Security Council; act of aggresion; resolutions; United Nations Charter; Chapter VII.
