Abstract

CORREA FREITAS, Ruben. Current overview of constitutional procedural law. Rev. Fac. Der. [online]. 2022, n.53, e301.  Epub June 01, 2022. ISSN 0797-8316.  https://doi.org/10.22187/rfd2022n53a2.

This work analyzes the importance of Constitutional Procedural Law as an independent Public Law discipline based on doctrine developments in Latin America and Europe. This discipline has become essential in the last forty years, with significant contributions from the academic and normative areas in modern constitutions. There is an issue concerning the terminology used in European and Latin American doctrine, especially regarding Constitutional Jurisdiction, Constitutional Justice, Constitutional Litigation, and Constitutional Procedural Law. This work examines various constitutionality review models in Comparative Law, starting from the traditional diffuse and concentrated models, known as the American and Austrian models, with an in-depth review of the hybridization of the traditional systems in Europe and Latin America.

Keywords : Constitution; control of constitutionality; diffuse and concentrated models; Constitutionalist Courts.
