Resumen

BRICHETTI, Florencia Mariana. Right to Health in the National Protocol for Comprehensive Attention of People with the Right to Legal Interruption of Pregnancy of Argentinian Republic: an International Human Rights Law Study. Rev. Fac. Der. [online]. 2021, n.50, e109.  Epub 01-Abr-2021. ISSN 0797-8316.  https://doi.org/10.22187/rfd2021n50a9.

The problem of access to non-punishable abortion in Argentina has been addressed from various fields and disciplines. The emergence of FAL ruling of the Supreme Court of Justice (2012) has motivated the issuance and modification of hospital protocols at Argentinian provinces, in order to establish the way in which health facilities in each jurisdiction should act when the practice of non-punishable abortion is requested, so that access to right to health is guaranteed. However, academy continues to draw attention to the alarming lack of adherence to human rights standards in access to the practice of legal abortion. In order to contribute to this debate, we intend to investigate whether the National Protocol for the comprehensive care of people with the right to legal interruption of pregnancy, complies with international human rights standards related to right to health.
