The consequences of mistakes decisions about the procedural options which process the insolvency debtor, there are not irrelevant. From those de resolutions can depend the debtor ´survival as economic entity, or his disappearance. Therefore, is not trivial a bankruptcy wrong decision. The doctrine have a role in give lineaments for putting in relief the characteristics, consequences, and social implications that have a mistake in the bankruptcy. This article pretend give a dogmatic view, from the economic analysis of law, about those issues. Moreover, I pretend examining the treatment of bankruptcy wrong decision in the new Chilean insolvency legislation.
