In the article we examine the negative effects on the purpose of the process, the punitive populism that prohibits the judge from granting the benefit of the suspension of the sentence in the case of the crime of minor injuries against women; assuming the position that in these times the criminal normativity is purely symbolic, ineffective and lacking interest in the system of guarantees, principles and values of the social State and of law.
