Abstract

This papers has as aim to compare two models of study of the right: the western one and the Latin American, concerning (around) concepts like the State, the Law and the Power. For it the text will be divided in three parts(reports): (1) A general sketch of the theory of the juridical interpretation, 1.1) going on to the theory of the constitution, (2) then to raise, in a very brief way, the general postulates ―of what we have called, for theoretical questions― of the “Constitutionalism of the South”, and ultimately, and (3) a comparative analysis between(among) both mentioned schemes, marking the similarities, but especially, trying to denote and to mark the asymmetries and Theoretical detachments with base in the concepts of condition(state), right and power.
