This research offers a genealogy of the intellectual property system, emphasizing its contingent nature and its need of adaptation to social demands which are related to technologies access to, and therefore, that serve them to social development. Accordingly, the democratizing potential of the regulation system to access to knowledge and technologies is highlighted since its functional logic to access can contribute to overcome the functional logic of exclusion dynamics that prevail in proprietary private system of modern property domain.
