Abstract

BARDAZANO, Gianella. Methodological Questions Related to the Juridical Positivism: “Our Concept of Law”. Rev. Fac. Der. [online]. 2018, n.45, pp.94-121. ISSN 0797-8316.  https://doi.org/10.22187/rfd2018n45a13.

This article intends to present an introductory outlook of the methodological and conceptual commitments of Joseph Raz` law theory, with the intention of approaching the particularities of a relationship between law and moral from the perspective of the author. Raz is a representative of the legal positivism as law theory and, moreover, without affecting the positivist character of his theory, he understands that there is no legal point of view apart from the moral point of view. One of the purposes of his theory is to provide an explanation for the nature of the type of social institution designated by our concept of law.

Keywords : Positivism; concept law.
