Abstract

The Supreme Court of Justice has that the "subject" to which the arts. 268 and 269 of C.G.P. It is not the subject of the proceedings that the appellant requests to be resolved by the Supreme Court of Justice, but rather the object of the process that was initially proposed in the application.

That interpretation could be not only lacking all legal support, but also contradictory to the purpose by which the legislator set a limit of economic importance to admit the appeal cassation.

This article analyzes this problem and presents new conclusions.
