The principle of separation of powers and the fear of entering into political issues or affecting the powers of other Powers of Government, remain as one of the most frequent reasons for the rejection of the writs of mandamus against the Government. In this piece, starting from a real case, the errors of those motives are analyzed and it concludes in the correct solution from the point of view of the Constitutional Law in force.
