The present research focuses on the legal bases that must govern the analysis of the contractual liability of tourism intermediation companies in Cuba. During the course of the study, some comparative law fundaments were laid on the one hand, and on the other one, from a national point of view, it has been analyzed the guiding principles of any action leading to achieving effectiveness in the functioning of national tourism companies, in keeping with the new ongoing socio-economic realities. To this end, the legal bases for analyzing the social responsibility of tourism intermediation companies have been determined. As a result of this theoretical-doctrinal study, it comes out that the harmonization of the internal tourism policy also requires a sound legal support in its functioning and interaction, from tourism and other economic activities involved in the implementation of the national policy.
