Abstract

JUNG, Pedro Ernesto Neubarth  and  ROCHA, Leonel Severo. The Twelfth Camel in the Judicial Power: a analysis from the Theory of Social Systems Autopoietic. Rev. Fac. Der. [online]. 2017, n.43, pp.32-52. ISSN 0797-8316.  https://doi.org/10.22187/rfd2017n2a3.

This paper addresses the behavior of Collegiate Judicial Bodies in the presence of an external element, the legal subsystem - the "Twelfth Camel". This analysis examines how the legal subsystem deals with the introduction of an external element in its operation, through Luhmann’s systemic observation. Thus, to accomplish this particular purpose, qualitative research methods previously applied in this study are used in addition to practical elements, such as the analysis of a particular case study, supported by bibliographic references. This is how solutions to the problem presented have been sought.

Keywords : autopoietic systems; courts; communication; legal subsystem; Niklas Luhmann.
