Abstract

DENES, Agustín Texo. Ignorance and opacity: a view to criminal law. Rev. Fac. Der. [online]. 2017, n.42, pp.199-224. ISSN 0797-8316.  https://doi.org/10.22187/rfd2017110.

This paper intends to be a general exposition on the problematic about ignorance and opacity of the Law -as two notions of different nature-, taken to the scope of Criminal Law, in which I intend to focus.

It is in the aforementioned branch of legal knowledge, where the State exercises the ius puniendi in the most direct and hard way, limiting the freedom of people. For this reason, ignorance and incomprehension of the Law, beyond being a problem of paramount importance in all branches, charges in the Criminal Law a place of relevance, especially in the theory of error.

Keywords : law; criminal law; ignorance; opacity; error.
