Nowadays it dues to Spanish Economic Crisis, a lot of business are obligatory to request a particular non-refundable subsidy, but, sometimes all the requirements or conditions are not expired. Moreover, many companies are immersed in a bankruptcy process too. Therefore, the purpose of our research consists in to know how the credit is qualified when it derived from a breach of the conditions of the non-refundable subsidy from the bankruptcy debtor, being very important the moment when the bankruptcy is declared and when the breach happens, because of this situation will depend the credit qualifies as bankruptcy credit or credit against the estate.
