Abstract

This article addresses the role that the Southern Common Market (hereinafter referred to as “MERCOSUR”) could assume concerning the legal environmental protection of aquatic and marine resources. Firstly, the current state of general regulations in force issued by MERCOSUR is analyzed. Secondly, the article focuses on environmental regulations adopted by MERCOSUR, specifically those pertaining to aquatic and marine resources. Then, the regulatory framework of the Río de la Plata Basin is analyzed in connection with the regulation of aquatic resources, since the geographical area of this basin is similar to that of MERCOSUR. The hypothesis is that MERCOSUR, as an institution, has made some strides in the regulation of overall environmental protection, especially with the creation of the MERCOSUR Framework Agreement on the Environment; however, there is still a long road ahead when it comes to specific environmental protection of both aquatic and marine resources.
