Summary Informed consent is an ethical and legal duty of the physician as well as a crucial point for the physician-patient relationship. Two issues are under discussion: on one hand, quantity, quality and way of communicating the information to the patient, and on the other the necessity to record the information. This consideration does not imply to forsake oral information, which is the base of consent. One hundred clinical histories of patients that underwent surgeries in the Hospital Maciel from April to June 2003 were analyzed. The authors did not design the form of the used generic consent. In 34 cases, written informed consent was not required. When surgery (coordination, urgency) was indicated, 9 out of 41 operated patients (coordination) and 25 out of 59 operated patients (urgency) did not present informed consent. Mistakes were seen in 8 obtained consents. In conclusion, there was a high percent of surgical procedures without written informed consent and some mistakes were proved in many documented consents. Thus, misunderstanding and lack of knowledge are still present in that area.
