This work examines the relations between democratic power, drugs policies and exercise of the right as they have developed in the American continent from the times of the independence revolutions to the present time. It highlights that the democratic governments thus restored were based on the assumption that free men consented to equal terms before the law. It is proposed that this democratic impulse underlies the considerable world-wide cannabis movement that has been fighting for the recognition of the right to consume marijuana for decades. Although very important in Europe, it’s in America where it has recently made obtained a significant achievement: the legalization of the cannabis in the North American states of Colorado and Washington and on a national scale in Uruguay. It is outlined that, in as much as the acceptance of the character licit of recreational consumption of marijuana implies an express recognition of the right in question, it refers to a “democratization of the social” in keeping with the equality and freedom requirements which have based our modern societies.
